Sellers/Consignors agrees to indemnify and hold harmless Florida State Auction its affiliates and their respective employees, contractors, agents, officers, licensors, managers and directors, from and against any and all claims, damages, suits, proceedings, investigations, actions, demands, obligations, losses, damages, settlement amounts,
fines, penalties, costs, expenses and any and all other liabilities (including but not limited to reasonable attorneys' fees and court costs) arising from or related to the following:
If we are prevented by fire, theft, or any other reason whatsoever from delivering any property to the purchaser, our liability shall be the amount of the Sold Hammer Price
Florida State Auctions reserves the right to withdraw any lot at any time before the auction without liability.
The auctioneer reserves the right to reject any bid not commensurate with the value of the property offered. A range of estimates may be given on a lot with either a low and/or high
estimate. Estimates should not be relied on as a prediction of the actual selling price; estimates are simply an opinion. If any applicable conditions herein are not complied with by the purchaser, Florida State Auctions at its option may either:
(a) cancel the sale, retaining as liquidated damages all payments made by the purchaser
(b) resell the property at public auction without reserve or minimum selling price, and the purchaser will be liable for any deficiency and costs, including handling
charges, expenses of both sales, the commission on both sales at regular rates, all other charges due hereunder and incidental damages.
Technology Disruptions.
Auctioneer will not be responsible for technology disruptions, errors, Or failures (including
disruptions to bidding or the failure to execute, recognize, or record online bids), whether caused by loss of connectivity, breakdown, disruption, or failure of the Online Auction Platform, errors in programming or set-up of the online Auction, (in) breakdown, disruption, or failure of a Bidder's internet connection, computer, or system, or otherwise.
Auctioneer may, but will not be required to, continue, suspend, delay, extend, reschedule, close, re-set, or re-start the Auction because of disruptions caused by technology failures or errors, even after bidding has commenced.
If arrangements are made for Florida State Auctions to pick up seller items, the items must be in the garage to allow for a "one-man" pick up.
The fee will be determined on an individual basis. The seller agrees that Florida State Auctions & Estate Sales will not be held responsible for any dents, damage or items that incur breakage during the pickup process and transportation of the items.
* Invention and Gadgets and Florida State Auctions are the same entity and interchangeable as the same company in reference to this contract.

Sellers: Florida State Auctions will be agent for the Seller and will sell listed items to the highest bidder by public or internet online auction at the commission as listed or typically 40% (some may vary) of gross total of the winning bid amount from the highest bidder for all items sold at the Public or Internet online auction. Florida State Auctions, will conduct the auction, furnish assistants and clerks as may be necessary, arrange Advertising and Mailings advisable to obtain maximum results, make all collections and finalize billing details directly connected with the auction.
SELLERS: All payments for purchases at the auction shall be made payable and delivered to Florida State Auctions who will furnish a complete accounting and settlement within 10 banking days after the auction.
SELLER agrees to allow Florida State Auctions to use its discretion and make the final decisions as to how items are to be sold, whether individually or lotted in a group.
SELLER agrees to allow Florida State Auctions to dispose of any item if deemed
unsellable, broken, or incomplete, without notice to the seller.
SELLERS will furnish Florida State Auctions, with a complete descriptive list of the items to be sold at auction, including serial numbers and any pertinent information which will appear in the advertising literature.
If there is no inventory list given, Florida State Auctions will determine how items are lotted.
SELLERS will deliver all the listed items and titles, if applicable, to the auction site no later than 7 DAYS prior to the auction date. The items must arrive in the cleanest, most functional condition practical.
Any misrepresentation by the SELLER as to description or condition will allow Florida State Auctions, to increase their agreed upon commission percentage on the
items sold at Florida State Auctions.
SELLER will maintain insurance and holds Florida State Auctions, harmless for any damage or liability claims resulting from involvement of equipment or property at the site until SELLER has been paid by Florida State Auctions.
SELLER will be liable for any theft, damage, fire damage or vandalism that may occur while on auction premises or while being handled by Florida State Auctions.
SELLER agrees NOT to bid on their own items.
IF SELLER IS DISCOVERED TO HAVE VIOLATED THIS PROVISION AND WINS THEIR OWN ITEM (items with stated reserves notwithstanding), A FULL FEE WILL BE DUE. SELLER MAY BE BANNED FROM FURTHER BUSINESS. On any items not successfully sold.
ASSEMBLY, DIS-ASSEMBLY Or REPAIR Services are billed at $50/hr, with a $25 minimum.
Auctioneer research is billed at $75/hr.
SELLER agrees to pay an additional $5 per lot or $50/hour if seller does not sort, inventory, or pre-lot their items to be sold at auction.
SELLER agrees to pay $10 No-Sale fee for items with reserves not met or items that did not receive any bid
PUBLIC SALE (in person live)
Florida state auctions and estate sales will conduct the auction in one of two formats:
Absolute, the item will sell to the highest bidder.
Reserve, The item will not sell unless the reserve price is met
Type of sale will be disclosed prior to auction start.
The buyer is responsible for collection and removal of all items won.
Florida State Auctions and its affiliates, auctioneers, clerks, pit workers, liability ends when the hammer falls, it is the buyers responsibility to Secure items won at sale.
Sellers/consignors
Items must be retrieved within three business days of the sale date after which time Florida State Auctions reserves the right to dispose of any items not retrieved in any matter that it sees fit.
